It's telling that the entire premise of the shadow docket is that lower courts are incompetent. Not wrong, not the normal judges-can-disagree stuff. SCOTUS is certain the Appellate and District courts are all so truly incompetent that they cannot properly decide injunctions, forcing SCOTUS to act.đ

In thinking about what to do about the rogue Court, we maybe focus a bit too much on court packing yes or no, granted that's the most important. But some of the less sexy things can be done by more mundane statutory fixes. Congress could, and should, nuke the shadow docket.

The frontier models try "distillation defense" to prevent reverse-engineering. Problem is, the methods (don't allow lower temperatures, mask thinking, etc) make the product worse and frustrate paying power users. Basically every proprietary AI will be rebuilt as streamlined open source eventually.

I think a lot of AI/corporate doomers are still fundamentally not understanding that open-source models you can run locally on consumer hardware are no worse than two years behind the frontier models and for most purposes a lot closer

Learn whatever you want about "law," it doesn't matter because GOP Justices blew up the entire process of deciding cases based on chats with rich friends and stuff they watched on TV. That was the entire basis on which SCOTUS switched to the shadow docket.
