On February 17, 2026, Special Agent Timothy Gerber caused a summons to issue
to T-Mobile US, Inc. concerning ten telephone numbers, one of which belongs to Ms.
Persigehl. The summons issued on HSI Form 3115, was captioned “SUMMONS To 
Appear and/or Produce Records, 19 U.S.C. § 1509,” and recited that production was
required:
in connection with an investigation or inquiry to ascertain the correctness
of entries, to determine the liability for duties, taxes, fines, penalties, or
forfeitures, and/or to ensure compliance with the laws or regulations
administered by HSI.
The summons was issued under the signature of an Acting Special Agent in Charge
located in Honolulu, Hawaii, and bears a digital signature executed from Lorton, Virginia
on February 19, 2026 — two days after the summons was dated and served. It was not
signed or authorized by a magistrate judge. T-Mobile responded the following day

Folks: I don't really care whether making an object lesson of the White House crime scene will stop it or whether Roberts was being genuine. This is an INCREDIBLY salient political opportunity, bc people hate seeing Trump destroy the White House.

Particularly given that Roberts wrote the dissent, the White House crime scene really should be the focus of activism to explain the problem with the existing court.

A curious ¶ in the Cities Church defendants' challenge to HSI's use of customs summonses to conduct much of the investigation. Neither of these cites get them where they want to go, throwing out the case for unlawful jurisdiction hung on customs summonses. storage.courtlistener.com….
The third-party doctrine is likewise beside the statutory point. A defendant’s
reasonable expectation of privacy concerns whether obtaining records constitutes a Fourth
Amendment search; it does not determine whether Congress authorized HSI to compel the
records through Section 1509. And recent Supreme Court decisions caution against treating
all digital information conveyed in ordinary cellphone use as freely available to the
Government. See Chatrie v. United States, 146 S. Ct. 2193, 2214–15 (2026); Carpenter v.
United States, 585 U.S. 296, 315 (2018).

A motion to dismiss in the Cities Church case reveals HSI/DOJ used customs summonses in that investigation at least 92 times. storage.courtlistener.com….
Defendants move the Court for an Order dismissing the charges against them based
on the Government’s investigative tactics that were not authorized by statute or rule and
violated their right to Due Process. The Government exercised powers Congress never gave
it. Defendants contend that the Department of Homeland Security (DHS) through
Homeland Security Investigations ((HSI), housed within DHS) undertook and materially
directed an investigation of alleged domestic civil-rights offenses under 18 U.S.C. §§ 241
and 248(a)(2), and then invoked a customs administrative summons 92 times to investigate
and prosecute those offenses. The threshold question is whether Congress authorized the
Government to exercise those powers here. It did not, for at least two reasons.
