This is inside baseball, but to me, there are three ways in which this development *bears out* Justice Jackson's unusual intervention Friday night—about which there was much confusion. First, this makes it clear that a majority of the Court was *not* going to force the USDA to fund SNAP by Friday.

#BREAKING: Over a public dissent from Justice Jackson, #SCOTUS *extends* the temporary pause of the district court’s order that had mandated full SNAP payments for November—keeping that ruling (and those payments) on hold through the end of the day this Thursday:

The trauma that this administration has DECIDED to inflict on hardworking Americans blows my mind — and I know them. My father was Dept Energy, my 1st postdoc was USDA, I have brilliant colleagues/friends across agencies now. It blows my mind. Personal, national, and global loss driven by greed.

The compact for decades was if you worked for the government you wouldn’t get rich but you would have a stable income that would allow you to live in dignity with benefits that you could retire on. They are destroying that understanding.

The end of the gov't shutdown arguably will moot all of this, but this extension of the order staying the district court decision in the Rhode Island case is both unnecessary and cruel--USDA should be required to provide full SNAP payments immediately.

For those who have asked where we are with the federal SNAP cases: Justice Jackson's administrative stay is set to expire 48 hours after the First Circuit ruled on USDA's request for a stay. That ruling hit the docket mid-day 11/10/25, so we have at least another 24 hours before the stay expires.

Trump’s DOJ have stated they will continue to fight against fighting SNAP. The USDA has reiterated its BAN on grocery stores offering discounts to SNAP recipients who can’t afford food. It’s a good thing the Dems didn’t do something nonsensical like cave for no reason…

Pursuant to the Court's order from this morning, this letter confirms that the government still intends to pursue a stay in this matter and will file a supplemental brief by 4:00pm this afternoon. I also write to inform the Court about two developments relating to this application.
First, last evening, the Senate voted to begin the process for ending the shutdown and funding the government-including full funding for SNAP through the end of the fiscal year. See Jordain Carney, Senate Advances Plan to End Historic Shutdown in Bipartisan Breakthrough, Politico (Nov. 9, 2025).' That proposal, if ultimately adopted by both Houses of Congress and signed by the President, would end the shutdown and moot this application.
Second, this morning, a district court in a related case issued a temporary restraining order.
That TRO purports to stay the USDA's November 8 memorandum that directed States that had processed full SNAP benefits for November without authorization to take immediate steps to undo those actions and revert to processing partial (65%) SNAP payments for November. See Order, Massachusetts, et al. v. USDA, et al., No. 1:25-cv-13165 (D. Mass., Nov. 10, 2025).

People will also die without SNAP, which could be only partially funded via the contingency fund alone through November and would have to dig into other general USDA funds that also fund WIC for December, and then things start getting iffy. All assuming SCOTUS rules the right way on SNAP.
