This is legitimately like one of *the* most important questions in those three circuits that allow as-applied challenges. The 5th Cir took a case en banc a few weeks ago to clean up confusion in its circuit about this question & here the 3rd Cir just lets confusion continue…

Bost was supposed to be the case that decided what evidence could be used to show someone was sufficiently dangerous to justify disarming under the felon-in-possession law. But the majority punts on that question--& specifically whether evidence *beyond the crime of conviction* can be used.

On Saturday in California, 4-year-old Jimmy Gramajo and 11-year-old Osmani Gramajo were killed after an apparent murder-suicide. Jimmy and Osmani were “so sweet, really good kids,” family members said.
