B. First Amended Complaint Properly Asserts In Rem Action
Defendants' Motion argues that the First Amended Complaint fails to allege an in rem
action against Parcel 11 because injunctive relief is sought and title to the property is not in
question. Contrary to Defendants' Motion, the First Amended Complaint properly asserts an in
rem action against Parcel 11.
In Estate ofSkepple v. Bank of Nova Scotia, the Supreme Court of the Virgin Islands
explained the scope of actions classified as in rem:
The term "in rem" has multiple meanings, though all related, depending on the issue
being discussed when the term is used. An "action in rem" is probably most
commonly understood as an "action determining the title to property and the rights
of the parties, not merely among themselves, but also against all persons at any time
claiming an interest in that property; a real action." Black's L. Dict., at 32. Another
common understanding of this term would also be an "action in which the named
defendant is real o[r] personal property." Id. "In rem jurisdiction" is a "court's
power to adjudicate rights to a given piece of property, including the power to seize
and hold it." Id. at 869. Whereas to call a proceeding "in rem" is to describe the
proceeding as 'Unyoking or determining the status of a thing, and therefore the
rights of persons generally with respect to that thing. Id. at 809. Interestingly, the
archaic term for this was "impersonal." Id. A "judgment in rem" then is a
"judgment that determines the status or condition of property and that operates
directly on the property itself. The phrase denotes a judgment that affects not only
interests in a thing but also all persons' interests in the thing." Id. at 860. In Massie
v. Watts, 10 U.S. (6 Cranch) 148, 158-59 (1810), the Court explained the distinction
at common law between
service in a proceeding in personam versus in rem. If the
judgment operated directly upon the person, a judgment in personam, service in
hand directly upon the person when she was within the territorial jurisdiction of the
state was essential to valid legal notice—valid service. McDonald, 243 U.S. at 91
("There is no dispute that service by publication does not warrant a personal
judgment against a nonresident." (citing Pennoyer, 95 U.S. at 714; Riverside &
Dan River Cotton Mills v. Menefee, 237 U.S. 189, 193-94 (1915) ) ).
S. Ct. Civ. No. 2014-0050, 2018 WL 4024983, at *9 n.13 (V.I. Aug. 17, 2018).
Accordingly, pursuant to Estate ofSkepple, an "action in which the named defendant is real
o[r] personal property" and a proceeding "[i]nvolving or determining the status of a thing, and
therefore the rights of persons generally with respect to that thing" are in rem actions. Id. Here,

I love his art work. Very stunning! Many decades ago, in my youth, I spent hours at the local university’s gallery displaying his master pieces. I had never seen such a different great style of painting. We were so lucky in Seattle to have him as a teacher, mentor and continue enjoying his murals.

A finished render of Garrett Stone, the adoptive father of Human-Demon Hybrid Emmie Ravenwing. Pictured here at 54, he always wears tattered clothing while his companions do not for the sole reason that due to his ability to change into his beast form, his clothing gets ripped anyway, so he'd rather wear something lose fitting and raggedy than something nice only for it to destroyed within days. Here he's holding his long time claymore that recently got a much needed resharpening and reforged with Purified Iron, a special type of iron ore that allows a Shaman to infuse the Shaman's Light permanently into any weapon that has it. The markings are the Shaman's Light runes interwoven into it by Sarah Highland.

Once the Major General of Lord Galerius's undead army, he defected when he discovered the Necromancer that killed his family was the one he was working for. He was lied to and vowed to seem him destroyed. After defecting, he was met by Emmie, who was tasked with killing him, but instead she wished to leave Lord Galerius's side as well, so she joined him on his adventures. Seeing as she had no family to speak of, he took her in as his daughter. Twelve years after Lord Galerius's death, him and Emmie met up with La-La's biological sister who also joined them, which would eventually lead to them meeting up with an unofficially recognized Shaman Master named Sarah Highland, who took a liking to him. After they were able to find some Purified Iron, his sword was reforged so that she could infuse it with the Shaman's Light, the best means to getting rid of the undead, demons and malicious spirits.

To verify images, digital forensics investigators will often check whether the geometry of the scene is realistic. In a real photo, lines that run parallel in reality—like floor tiles—should meet at a single vanishing point. In this image, however, the dotted lines do not meet in a single point, indicating it is a fake.

Shadows can be a giveaway, too. Because the Sun is so far away, its rays are essentially parallel when they reach Earth's surface. That means that the lines connecting points on an object to the shadows they cast in sunlight should also intersect at a vanishing point. In this Al-generated image, that is clearly not the case.
